Clients who have accepted and paid invoices for services supplied by
Monaghan Media Pty Ltd accept the following terms and conditions.
SECURITY - Monaghan Media Pty Ltd or any of its directors or
employees shall not be held responsible for breaches of security at the
Clients place of business. Clients are supplied with a unique username and
password to access their Websites, and the Clients are responsible for the
protection of that information. Any breach of this responsibility and the
subsequent publishing of unauthorised material is the responsibility of
the Clients solely and Monaghan Media Pty Ltd or any of its directors or
employees shall not be held responsible in any way.
CONTENT - Any material found on any website on the Monaghan server
deemed to be outside the Australian Broadcasting Authority censorship
guidelines, shall be deleted immediately and the Clients will have no
rights in the matter. Monaghan Media Pty Ltd or any of its directors or
employees shall not be held responsible in any way for the publishing of
the said material.
LINKS - Our website may contain links to
other sites not affiliated with us. We take no responsibility for the
polices or practices of these sites.
COPYRIGHT - Any material on any website on the Monaghan server
which is in breach of Copyright guidelines shall in no way incriminate
Monaghan Media Pty Ltd its directors or its employees. Monaghan Media Pty
Ltd or any of its directors or employees shall not be held responsible in
any way for the publishing of the said material.
PAYMENT - Accounts are finalised at the end of each calendar month.
An invoice is issued with a due date. Should an invoice remain unpaid
after the due date, unless Monaghan Media Pty Ltd support has been
contacted to extend the invoice, the account will be suspended without
further notice until the account is paid.
BANDWIDTH - Additional Data Transfer fees are charged using the
following formula. Total Data Transferred calculated at the end of each
month in megabytes is halved. This figure is then reduced by 1 Gigabyte
which is the Premium Website Hosting limit. The final figure is then
multiplied by $0.15 which is our fee for each additional megabyte.
REFUNDS ON CANCELLATION - Cancellation of
services shall not constitute either a refund or a cancellation of the
relevant invoice. All services are invoiced in advance and are paid in
advance whether the service is cancelled before the expiry date or not.
When the expiry date of the invoice arrives and payment has not been made,
the service will be terminated.
SPAM - Clients will not use the Monaghan SMTP
server to send unsolicited emails. The SMTP server is secured against
unauthorised use and it will be monitored so that clients who do attempt to send
unsolicited emails can be traced. Clients found sending spam will be dealt
with in an appropriate manner and will be stopped.
